I had asked a member in a thread "Law", if she was approached to re-try this case would she rather prosecute or defend?

It's an interesting question:

Any one have a preference?

Interesting question.  I think I would rather prosecute provided I could start from the beginning. From August 4th.

Of course that's Monday morning quarterbacking in that I would know what went wrong with the prosecution.

I don't think I would have gotten a different result however.

BTW, congratulations on going over 4,000 posts!!

Thanks Kimberly!

Would you rather prosecute Lizzie or defend Lizzie in court?

Um, I think I would rather defend her -- it is hard to
prosecute someone when you have no physical proof they
did something except for them being there. The new trials
seem to find her not guilty too -- may as well be on the
winning side. Plus, I think if I were the prosecution
I would get so frustrated with her non-answers & pouting &
beating-around-the-bush I'd jump up & down on her.

Congrats, Kat, on your 4019th post!

When you say retry the case, does that mean that Lizzie would still be alive or just retry it with what we know today?  Because if it was Lizzie still alive, I'd PROSECUTE!  Do I get to do what Knowlton did?  Grill her at an inquest again?  Maybe as a woman I might be able to get more out of her?

You get to do whatever you want, whenever.
If you see it as 1893, then so be it!

Well, if thats the case, I would study where Knowlton seems to drop the ball in his line of questioning and drive a little bit harder in those directions.  Heck, I'd probably even go and search the Borden house myself.  Knowing what we know now and being able to go back and do it again, I'd prosecute!

I might be interested in defending, mainly I think because I could get the real story out of Lizzie, even if I could never tell.
I suppose I would be trained by then, in my profession, to not ever be tempted to tell.
I think I might have to move away with secrets like THAT!

Besides, if I really disagreed with the death penalty that might assauge my conscience in defending her.
