Anyone know what country Jennings is referring to?

From Jennings' opening argument:
Seems like it might have been an urban legend (if that's the right expression) of the day.I know there is---I am told there is---one country at least, one of the great countries of the world, where it has been the practice, in case there is no direct evidence of who the murderer is, to measure the distance to the nearest person at the time when the murder was committed, and if he cannot prove his innocence or make known the guilty party, he is executed, the rules of that country requiring that somebody shall be punished for the crime.
