From Jennings' opening argument:
I know there is---I am told there is---one country at least, one of the great countries of the world, where it has been the practice, in case there is no direct evidence of who the murderer is, to measure the distance to the nearest person at the time when the murder was committed, and if he cannot prove his innocence or make known the guilty party, he is executed, the rules of that country requiring that somebody shall be punished for the crime.
Seems like it might have been an urban legend (if that's the right expression) of the day.

Jennings said "where it has been the practice" meaning he might have meant it in the past tense, in that they did that at one time but not now ( 1893 ).

Considering how Barbaric and unfair some Cultures were in ancient times there are a few Countries that might have done that kind of thing.
