While browsing the trial transcript, I noticed an interesting statement by Hymon Lubinski, the young man who peddled ice cream on second street at the time of the murders. While being questioned by Jennings, here is what he said regarding the woman he saw walking towards the back stairs:
P. 1409
Q. Did she have anything on her head?
A. No Sir.
Didn't Lizzie say that she was wearing a hat during her time in the barn and came in a set it on the kitchen table?
Also, the following questions were posed;
Q. What was she doing?
A. She was walking
Q. What was she doing?
A. She was walking very slowly
If I am not mistaken, didn't Lizzie say that she had heard a groan and some scraping sounds as she was walking towards the house? Wouldn't a person normally rush towards the house in these circumstances?
To me, the above indicate more conflictive and contradictory statements by Lizzie.

I personally believe that she may have been out to the barn for a different reason than what she said- whether it was to hide something or wash something or hope someone saw her outside (maybe that's why she was walking slowly.) I think she was intending to go out after the murder of Abby and was dressed, ready to go (thus the dark dress Hymen saw her in) and then Andrew came home early which changed her plans. She probably had her hat on the table to put on to go into town but then couldn't use it. I think she saw her dad lie down so she changed her dress again or did whatever she did to protect herself from the blood and then proceeded to kill him too.

Re: Testimony of Hymon Lubinski
Lizzie didn't testify that she was wearing a hat. She only said she put her hat down in the dining room after she came in. (Note- she did not say where in the D.R. she put it)chuckciao @ Fri Jan 04, 2008 10:32 am wrote:While browsing the trial transcript, I noticed an interesting statement by Hymon Lubinski, the young man who peddled ice cream on second street at the time of the murders. Also, if Lizzie did not know anything had happened or would happen or might happen, hearing a noise from the house or the screen door might not alarm her to the point of automatically rushing in.
Did she say she rushed in, in response to a sound?
